Cool chair. Without knowing more, the "bong water" thing sounds like they wanted to charge something more serious but couldn't so just settled for what they could charge. And, yeah, it's abuse of discretion.

The chair is pretty amusing. How the guy thought he could get away with it though, is pretty stupid. Every so often I read about somebody driving their riding mower or something like this on the street while drunk. Almost universally they have had their license to drive suspended or revoked because of prior alcohol related convictions and almost all express surprise because they were not driving a regular car or truck. Same with boaters thinking they can't get a BWI while in a motorized canoe. The law is quite clear: if it's motorized and one drives it drunk, they can nail you.
